Talent Visa (R Visa / K Visa)
I. Scope of Application
These guidelines apply to foreign high-level talents (R Visa) and young science and technology talents (K Visa) applying to work or engage in innovation and entrepreneurship in China, covering the following two categories:
R Visa: Foreign high-level talents urgently needed by the state (such as scientists, leading technology professionals, and international entrepreneurs).
K Visa: Qualified young science and technology talents in STEM fields (pilot program in Shanghai effective 2026, applicable to applicants aged 18–35).
II. Application Procedure
Phase I: Domestic Employer Application for Notification Letter of Foreigner’s Work Permit
1. Online Registration and Document Submission
(1) The employer shall log in to the “Service System for Foreigners Working in China” (https://fuwu.mohrss.gov.cn), register an account, and complete organizational information.
(2) Submit the following materials:
Organizational Qualifications: Duplicate of business license (bearing official seal), and industry-specific qualification certificates (such as school operating permits for education or practice licenses for medical institutions).
Talent Qualifications:
R Visa Applicants: High-level talent confirmation letter (recognized by the Ministry of Science and Technology or Ministry of Human Resources and Social Security), or proof of international awards (such as Nobel Prize, Turing Award).
K Visa Applicants: Bachelor’s degree or above in STEM fields (authentication required), and scientific research work proof (such as publications, patents).
Employment Contract: Chinese and English versions, specifying position, salary, and term (salary shall not be lower than the local average wage for equivalent positions).
Other Materials: Certificate of no criminal record (notarization and authentication required), health certificate (valid within six months), scanned copy of passport.
2. Review and Verification
The local science and technology bureau or foreign experts affairs bureau shall conduct preliminary review of materials (5–15 working days), and may request supplementary materials or an interview.
Upon approval, the system generates an electronic Notification Letter of Foreigner’s Work Permit, which the employer downloads and transmits to the applicant.
Phase II: Applicant Visa Application
1. Visa Document Preparation
(1) Basic Documentation:
Original passport and photocopy with validity of at least six months.
Completed Visa Application Form of the People’s Republic of China online, with two-inch bareheaded identification photograph with white background.
Original Notification Letter of Foreigner’s Work Permit (marked for “work visa” purpose).
(2) Supplementary Documentation:
Round-trip flight reservation (required by certain embassies/consulates).
Accommodation certificate (hotel reservation or residence certificate issued by the inviting party).
Financial documentation (such as bank statements, required by certain countries).
2. Application Submission and Biometric Collection
Schedule submission appointment through the official website of the Chinese embassy, consulate, or visa center.
Submit materials on site, pay visa fee, and provide biometric data (fingerprint collection). Exemptions apply to children under 14 years of age and holders of diplomatic passports.
3. Processing and Visa Collection
Standard processing time is 3–7 working days; expedited service available (additional fee required).
Upon approval, collect visa as notified (R Visa validity: 5–10 years; K Visa validity: maximum 5 years, with 180-day stay per entry).
Phase III: Post-Entry Procedures
1. Temporary Accommodation Registration
Within 24 hours of entry, report temporary accommodation registration to the local police station of the place of residence (hotels may process on behalf of guests).
2. Application for Work Permit and Residence Permit
Within 30 days of entry on the Z Visa, the employer shall apply through the system for the Foreigner’s Work Permit (physical card).
Submit the work permit, passport, health examination report, and other materials to the local exit-entry administration to apply for the work-type residence permit (validity: 1–5 years).
K Visa Applicants: May apply directly for work permit after entry without exiting to convert visa category.
III. Key Considerations
1. Document Authenticity and Compliance
All materials must be authentic and valid; fraudulent or concealed information will result in visa refusal, blacklisting, or legal liability.
Academic credentials and certificates of no criminal record require notarization and authentication (Apostille accepted for certain countries).
2. Salary and Contract Requirements
Salary shall not be lower than the local average wage for equivalent positions; contracts must specify social insurance contribution terms.
Effective 2026, the annual salary threshold for Category A talents in Shanghai is adjusted to approximately RMB 900,000, and Category B talents to approximately RMB 600,000.
3. Policy Updates and Regional Variations
Monitor updates from the National Immigration Administration and Ministry of Science and Technology websites; certain cities (such as Shanghai and Shenzhen) pilot “points-based” assessment systems or simplified procedures.
For example, Shanghai K Visa applicants need not obtain an employing unit in advance and may apply in their personal capacity.
4. Post-Entry Obligations
Engagement in activities inconsistent with the visa category is strictly prohibited (such as K Visa holders engaging in non-STEM field work).
Within 10 days of employment termination, the employer must cancel the work permit and residence permit.
5. Emergency Circumstances
In the event of lost or damaged documentation, apply for the Alien Exit-Entry Permit at the local public security authority, submitting materials including passport loss certificate and diplomatic note from the home country’s embassy or consulate in China.
IV. Practical Recommendations
Advance Planning: Initiate application at least 2–3 months in advance, allowing time for supplementary documentation.
Professional Assistance: Engage employer HR or professional agencies to assist with processing, avoiding delays due to unfamiliarity with procedures.
Policy Consultation: Contact the National Immigration Administration service hotline (12367) or the relevant embassy/consulate to confirm details.
Document Backup: Prepare electronic copies and photocopies of all materials to prevent loss.
